A member has requested a survey of all members to assess sales tax revenue assumptions and estimates for 2010.  These things can change as additional budget time elapses, but I expect everyone has by now formalized their initial estimates.  Please answer each of the following questions:

Background:  Richard Walsh from Whatcom Transportation Authority has been directed to prepare a ballot measure for 2/10th of a percent for an April 27, 2010 vote.  WTA has been working with the Public Disclosure Commission to prepare and distribute a neutral informational item about the ballot measure.

Questions: 
1. Do any of you who have recently gone with ballot measures have samples of an informational piece that complies with the PDC requirements?  If so, can you send it in pdf form?  We can keep a resource library of them – and share them with those of you who are looking for samples.

2. Have you gone out with a ballot measure in the past few years?  You may be a good resource for an agency about to go to ballot.

3. Are any of you considering ballot measures this year or next?   If so, you may be able to use other agencies as resources if you have questions.

With the funding cut on Medicaid riders to adult day health, those riders are turning to public transit. Currently, we do not bill the adult day health center in our area, but the ADA does allow for us to do just that.

We have had our annual audio logical testing done recently for our drivers. The Audiologist recommended, based on some hearing loss by some of our drivers, that we provide ear plugs to our drivers. What is your policy regarding securement for children who accompany para transit riders? 

We are looking to update our policy that now states the following:
Children from birth to age 3 who accompany our customers are required to be secured with seat belts or car seats appropriate for their age, weight, and condition. The passenger is responsible for providing an appropriate car seat that works in our vehicles. Drivers cannot carry or lift a child on or off the van.

Does your agency require paratransit drivers and/or contracted transportation drivers to obtain/maintain a CDL (Class C w/ passenger endorsement) even when they’re only operating vehicles that do not meet the definition of a commercial vehicle? In other words, the vehicles are less than 26,001 pounds (GVWR) and are designed to carry 15 or less passengers including the driver. Secondly, if your agency does require drivers or contracted drivers maintain a CDL, do you include these drivers in the FTA random drug & alcohol program as safety sensitive employees? If you’ve answered yes to either of the above questions, please explain why.

We have a passenger that uses an electric wheelchair. The combined weight of the passenger and the chair is in excess of 700 pounds. On several occasions the battery on the chair has died and our dispatcher has asked the driver, and on occasion another employee like the bus washer, to push the passenger and chair to his destination. Our service is door-to-door, but if there is a mechanical failure like the battery running out, does it then become our responsibility to accommodate the passenger? In the past our philosophy was to assist the passenger off the vehicle, but not to load them into the vehicle if the chair battery was already dead. Our drivers do not wear back belts for heavy lifting or pushing. What do you do in this situation?
